SBB P+Rail GTC.

General terms of business for use of the P+Rail app, mobile tickets and P+Rail facilities.

Preliminary remarks.

These GTC contain:

  • Terms and conditions governing the use of P+Rail facilities owned by SBB
  • Terms and conditions governing P+Rail tickets and the range of P+Rail passes
  • Terms and conditions governing the use of the SBB App for P+Rail facilities (hereafter “P+Rail app”)

General terms and conditions governing the use of SBB P+Rail facilities.

  • SBB P+Rail facilities are available exclusively for the parking of properly registered and roadworthy light motor vehicles (up to 3,500 kg) for a maximum of 7 days, one after the other. P+Rail facilities may not be used whilst engaging in commercial activities (taxis, car journeys, driving schools, etc.).
  • Acceptance of SBB P+Rail GTC Any person who enters the P+Rail facility in a vehicle shall be deemed to have accepted these GTC and undertakes to comply with them.
  • Persons with a disability Persons with a disability may display the disabled persons’ parking badge issued by their cantonal authority and are thus exempt from paying the parking fee.
  • Unauthorised usage Any usage other than the parking of light motor vehicles (up to 3,500 kg) within the marked parking spaces is prohibited, including in particular:
    • Parking caravans or motorhomes, vehicles with trailers, bicycles or motor-assisted bicycles
    • Parking vehicles whilst engaging in commercial activities (taxis etc.).
    • Parking any vehicles other than light motor vehicles (up to 3,500 kg)
    • Camping
    • Cleaning or repairing vehicles
    • Topping up or draining off cooling water, fuel or oil
    • Storing flammable items and materials, waste or rubbish
    • Posting or distributing advertising materials (flyers, business cards, etc.) without the written approval of the licensed transport operator
  • Breach of the terms and conditions of use.
    If the P+Rail facility is occupied for longer than the period of use paid for, or if the parking charge has not been paid in advance, a surcharge of CHF 40 per day or part thereof is payable.
    An administrative fee of CHF 40 will be charged in the event of any breach of the parking regulations or any unauthorised use. The foregoing is without prejudice to any entitlement to claim additional compensation.
    SBB shall be entitled to arrange for a vehicle to be towed away at the vehicle owner’s expense if:
    • any leaking part or other defect represents a hazard to the proper operation of or risks causing contamination to the site;
    • the vehicle is not roadworthy or has been taken off the road by the police;
    • a vehicle is parked in a way that contravenes the above terms and conditions of use.
  • Usage of P+Rail services Any individual SBB services and products are also subject to the relevant terms and conditions (e.g. for usage of the P+Rail facility, the terms and conditions of use possible displayed at the relevant location). In the event of any discrepancy, the special terms and conditions shall take precedence.
  • Some parking locations are not operated by SBB, but rather by other companies. The terms and conditions of use of the relevant operator must be complied with for parking locations operated by third parties.
  • Any instructions issued by staff and authorised SBB officials must be complied with.
  • Usage of the P+Rail facility is at the user’s own risk. This is the case in particular in the event of wintry conditions. Users shall be liable for any personal injury, damage to property, financial loss and any other damage caused either wilfully or negligently by them or by auxiliary agents arising either directly or indirectly for SBB as a result of any breach of these GTC or other regulations or any violation of legal obligations.
    SBB shall not incur any liability for losses of any type, including liability for auxiliary agents and third parties. In particular, the operator shall not incur any liability for losses arising due to force majeure, acts of vandalism or damage caused by vehicles, theft, etc.

General information.

The provisions applicable to P+Rail tickets and the range of passes shall also apply for the booking of parking spaces at P+Rail facilities of SBB as well as those of third-party providers. Where a third party parking product is booked, SBB only acts as an intermediary between the customer and the site operator. A contract is concluded directly between the customer and the site operator.

The P+Rail ticket/pass grants the right to park a properly registered and roadworthy light motor vehicle (up to 3,500 kg total weight) at the relevant parking facility for the validity period of the ticket/pass, provided that a free, marked space is available for this purpose.

You are not entitled to a reimbursement if there are no available spaces. No claims for damages or loss of profit due to a fully occupied P+Rail facility will be accepted.

Parking tickets do not need to be displayed in the car (except for parking tickets on security paper, e.g. Prisma day passes). The number plate is recorded at the time of sale and can be viewed by the inspector. The correct car number plate must be recorded in the system, as this is the only way to ensure that proper checks can be carried out. The full number plate must be entered including letters and without any spaces. Information such as "red Fiat" or "car in parking space 5" cannot be processed. If the number plate is not recorded correctly by the customer, he/she will be liable to pay a surcharge of CHF 40.00 in the event of an inspection.

When placing a binding order for a ticket or pass via one of the sales channels, customers declare that they agree to these general terms of business on sbb.ch/parking.

P+Rail hourly and day passes.

Concept – types – validity.

The following hourly and day passes are issued

  • P+Rail hourly ticket via the P+Rail app or a local parking meter
  • P+Rail 24h ticket via the P+Rail app
  • P+Rail Day Pass via the webshop, travel centre, ticket machine or local parking meter

Eligibility to purchase.

P+Rail hourly ticket, 24h ticket and Day Passes can be purchased by all customers. A valid travel ticket is not required in order to purchase a P+Rail Day Pass. Holders of public transport tickets do not receive any discount.

P+Rail Monthly and Annual Pass parking.

Concept – types – validity.

The following P+Rail passes are issued:

  • P+Rail Monthly Pass parking
  • P+Rail Annual Pass parking

Annual and monthly passes are sold at the ticket counter, in the webshop or via the SBB Contact Centre.

The first day of validity of a pass can be freely chosen (flexible dates). P+Rail passes can be purchased 2 months in advanced.

Issue.

The P+Rail pass is issued on SwissPass. The pass is not automatically renewed. Customers must hold a personal SwissPass card in order to purchase a pass.

P+Rail passes are only issued to customers with a valid personal GA, GA-FVP, route, module or network travelcard. A valid personal annual public transport travelcard is required in order to purchase a P+Rail pass. A valid personal monthly public transport travelcard is sufficient in order to purchase a P+Rail Monthly Pass. A Half Fare Travelcard does not entitle the holder to purchase a P+Rail Monthly or Annual Pass. The public transport travelcard must be valid on the first day of validity of the P+Rail pass.

Eligibility is actively checked by inspection of a valid route, module, network or GA travelcard.

Only one P+Rail pass can be purchased for each public transport travelcard.

After the SwissPass login details have been entered, the webshop checks whether a travelcard is held. If a travelcard is held but is not visible on the SwissPass (for example: GA-FVP), it is not possible to conclude a sale via the webshop. In such cases, a sale may be concluded at a public transport sales counter.

P+Rail passes may be subject to a quota. Sales are only possible subject to the applicable quota.

P+Rail passes are only valid for one location at any given time.

Recording of vehicle number plates.
Two vehicle number plates may be registered for each P+Rail pass. However, only one car may be parked using the P+Rail pass at any given time.

It is not possible to change the vehicle number plate during the validity period.
If it is necessary to change the number plates recorded, the pass must be reimbursed on a pro rata basis and a new pass must be issued from the reimbursement date. This will result in a corresponding extension of the existing pass. Alternatively, monthly passes can be purchased instead of a new annual pass.

Exchanges and reimbursements.

P+Rail app tickets and parking meter tickets.

As a general rule, P+Rail app tickets and parking meter tickets cannot be reimbursed or exchanged.

Reimbursement is only possible if it is possible to prove that the ticket has not been used.

  • In the event of death
  • If the customer is unable to travel, subject to presentation of a doctor’s certificate
  • The purchase of multiple tickets (travel date, location and passenger – full name and date of birth – are identical)
  • Ticket with incorrect car number plates (for evident input errors only)

In order to obtain a reimbursement for a P+Rail app ticket, customers must submit a written request to the SBB Contact Centre. A form is available for this purpose in the P+Rail app.

In order to obtain a reimbursement for a parking meter ticket, customers should contact their local travel centre or SBB Customer Service.

P+Rail Day Pass (NOVA) and P+Rail passes (NOVA).

Reimbursement in the event of non-use:
Reimbursement is only possible if it is possible to prove that the ticket has not been used.

  • In the event of death
  • If the customer is unable to travel, subject to presentation of a doctor’s certificate
  • The purchase of multiple tickets (travel date, location and car number plate are identical)
  • Ticket with incorrect car number plates (for evident input errors only)

No processing fee is charged for self-service sales (webshop). A processing fee of CHF 10.00 will be charged for the reimbursement of any in-person sale.

Pro rata reimbursement of monthly and annual passes:
Entitlement to a pro rata reimbursement shall arise under the following circumstances:

  • Death
  • If the customer is unable to travel, subject to presentation of a doctor’s certificate
  • Closure of the P+Rail facility by SBB
  • Change of the vehicle number plate followed by the purchase of a new subscription

Calculation of pro rata reimbursement:

(Price paid x unused days) / 365

The amount reimbursed is rounded down to the nearest franc. A processing fee of CHF 10.00 will be charged in the event of death/incapacity to travel. No processing fee will be charged in the event of an exchange/upsell.

Usage of information on the “P+Rail app”.

All content (text, graphics, images, etc.) on the “P+Rail app” is protected by copyright and, unless specified otherwise, is owned exclusively and in full by SBB. This also applies in particular to the word, image and/or acoustic trademarks and logos displayed in the “P+Rail app”. These webpages may also contain references to the property and user rights of third parties, which must also be taken into account.

The information and services contained on the “P+Rail app” are provided by SBB for private use and information purposes only.

Individual pages and/or subsections of the “P+Rail app” may be reproduced, provided that no copyright marks (e.g. SBB©) or any other designations protected by law are removed. SBB retains all proprietary rights and usage rights. SBB may withdraw this consent at any time.

Written permission must be obtained from SBB prior to reproduction (full or partial), transmission (electronically or by other means), modification, linking or use of the information and services contained on the “P+Rail app” in any form for public or commercial purposes.

Linked websites.

If any links are incorporated into the “P+Rail app” that direct you to third-party websites, SBB does not accept any responsibility for the accuracy, completeness or lawfulness of the contents contained on such sites and for any links to other websites or for any offers, products or services available on such websites. These websites are no longer under the control of SBB. This shall also apply in the event that these websites contain the SBB logo or any other protected designation. Any linked websites are therefore used at your own risk.

Common terms and conditions.

Data protection.

Protecting your privacy is important to SBB. SBB ensures that the statutory data protection requirements laid down in the Swiss Federal Act on Data Protection (FADP) are complied with.

No disclosure of information.

It is essential for you to provide your data in order to purchase P+Rail products and services.

Your personal data will not be sold or passed on to third parties outside the SBB Group. However, your personal data may be forwarded to the providers of third-party services (address, license plate, paying information, booked location, booked period) offered via the SBB sales channels for the purpose of processing contracts. The third-party providers are obliged to guarantee the security of data and to comply with data protection regulations.

Market research.

SBB reserves the right to analyse users’ customer data and to conduct electronic surveys of them for the purpose of continuous service quality improvement. If you do not wish to participate in such surveys, you can opt out of participating in the surveys by sending us an email to the following address: parkandrail@sbb.ch.

Storing and backing up your data.

SBB will take appropriate measures and use the necessary security technology to protect its data. The data will be stored only as long as they are needed for the relevant purpose.

Questions concerning data protection.

Applicable law and place of jurisdiction.

The courts of Bern, where SBB has its registered office, shall have sole jurisdiction over any disputes arising in relation to the operation or use of the P+Rail facility between you as the user of the P+Rail facility and SBB. Swiss law shall be exclusively applicable.

Amendments to the P+Rail GTC.

SBB reserves the right to amend, supplement or cancel these P+Rail GTC at any time either in full or in part at its absolute discretion. This also applies to improvements and/or changes to the information, products and services described.
