These General Terms and Conditions ("GTC") apply to all legal relationships between SBB AG ("SBB") and its customers regarding the identification and billing of PubliBike Velospot services using Tap&Go technology, unless additional reference is made to other General Terms and Conditions.

By using the Tap&Go service and holding the SwissPass card up to a PubliBike Velospot bicycle, the customer accepts these GTCs. These form an integral part of the contract concluded between SBB and the customer ("the Contract"). Any differing terms stipulated by the customer or any changes and/or additions to the GTC by the customer are of no relevance or validity to SBB unless SBB expressly agrees to their validity in writing.

PubliBike Tap&Go only works if the SwissPass is not already stored as an access medium for a PubliBike Velospot account. If the SwissPass is already linked to a PubliBike Velospot account, use is billed via this account and is charged at the rate of the PubliBike Velospot subscription stored there.

The prices for use of the bikes and other conditions are published on the PubliBike Velospot website.

If a customer uses their SwissPass for identification purposes, payment will be made using the payment method stored in their SBB account. Otherwise, the SwissPass privacy policy applies.

The costs for use are debited to the stored means of payment immediately after completion of the journey.

The bicycles and the Tap&Go technology are generally available to customers 24 hours a day, 7 days a week. However, SBB cannot guarantee that the system will function without interruptions or faults, nor can it guarantee the availability of bicycles at certain locations. SBB is authorised to temporarily restrict or interrupt the availability of Tap&Go in the following cases in particular:

• In the event of system faults, maintenance and update work.
• In the event of an interruption in the telecoms lines or Internet connection between the Tap&Go technology and the SBB or PubliBike Velospot servers.
• in cases of force majeure, extraordinary events and natural phenomena.

In respect of itself and its auxiliaries, SBB shall be liable only for damage caused wilfully or through gross negligence. Any further liability on the part of SBB, in particular for consequential damage, loss of profit or lost or altered data, is excluded.

The SwissPass privacy policy applies to persons who use the SwissPass for identification purposes. The data is anonymised for analysis purposes after 12 months. 

SBB collects and processes personal data exclusively within the framework of the applicable legal provisions and uses it only to process the use, maintain the customer relationship and further develop the Tap&Go service.

SBB shall implement state-of-the-art measures to keep personal data confidential and to protect data against unauthorised access.

Should one of the provisions of these T&C be or become invalid or unenforceable, the validity of the remaining provisions of these T&C shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid or enforceable provision that most closely reflects the invalid or unenforceable one in legal and commercial terms.

The contract and the rights and obligations arising from it may not be transferred without the other party’s written authorisation.

This contract is subject to Swiss substantive law. The exclusive place of jurisdiction is Bern.
