General terms and conditions for the use of bicycle parking facilities (Bicycle Parking GTC).
1 Scope.
1.1 These Bicycle Parking GTC apply to the use of bicycle parking facilities owned or managed by SBB.
1.2 By using the bicycle parking facility, you will be deemed to have agreed to the following terms and conditions.
1.3 Specific terms and conditions of use
Any site-specific terms and conditions of use applicable to individual bicycle parking facilities shall apply in addition to these GTC. In the event of any contradiction, the special terms and conditions take precedence.
1.4 Amendments to the Bicycle Parking GTC
SBB reserves the right to amend, supplement or cancel these Bicycle Parking GTC at any time either in full or in part at its absolute discretion. The same right applies to improvements and/or changes to the information and products and services described.
2 Usage of bicycle parking facilities.
2.1 It is permitted to park any serviceable two-wheeled vehicle (bicycle, e-bike, motorcycle) in an orderly manner in any bicycle parking facility, provided that a free space is available. Larger vehicles (especially three-wheeled or four-wheeled vehicles) may not be parked in bicycle parking facilities. This does not apply to special bicycles (e.g. cargo bikes, bicycles with trailers).
2.2 No claims for damages or loss of profit due to a fully occupied bicycle parking facility will be accepted.
2.3 Bicycle parking facilities may be used, as a general rule, in conjunction with a rail journey. Permanent parking for a longer period of time is prohibited.
2.4 Non-authorised use
Any usage other than for the parking of vehicles within the marked parking spaces in the bicycle parking facility is prohibited, including in particular:
- Parking of three-wheeled or four-wheeled vehicles (except special bicycles, such as e.g. cargo bikes, bicycles with trailers)
- Cleaning and repair of two-wheeled vehicles (except bicycle parking facilities with washing and/or repair stations)
- Draining and topping up fuels, oils, etc.
- Storing flammable items and materials or waste and rubbish
- Posting or distributing advertising materials (flyers, business cards, etc.) without written permission from SBB
- Commercial use (advertising, sale, rental, etc.) without the written permission of SBB
2.5 Exclusion of liability
Usage of the bicycle parking facility is at the user’s own risk. This particularly applies in wintery conditions. Any liability on the part of SBB is excluded to the extent permissible by law, particularly in the event of theft of and damage to the parked bicycles.
2.6 Infringement of the terms and conditions of use
SBB is authorised to arrange for a vehicle to be removed at the cost of the user and, if necessary, to destroy any locks without compensation in order to do so if:
- the bicycle/vehicle is no longer serviceable
- for motorised vehicles: the vehicle is not roadworthy or has been taken off the road by the police;
- a bicycle/vehicle is parked in a way that contravenes the above terms and conditions of use.
Any permanently parked vehicles will be marked as such and removed after a certain period of time. Any two-wheeled vehicles that are removed will be placed into storage. After a certain period of time, any such two-wheeled vehicles may be disposed of or repurposed. An administrative fee of CHF 40 will be charged in the event of any breach of the parking regulations or any unauthorised use (parking of larger vehicles). The foregoing is without prejudice to any entitlement to claim additional compensation.
Instructions issued by SBB staff and authorised SBB representatives must be complied with.
3 Place of jurisdiction and applicable law.
The courts of Bern, where SBB has its registered office, shall have sole jurisdiction over any disputes arising in relation to the operation or use of the bicycle parking facility between you as the user of the bicycle parking facility and SBB. Swiss law shall be exclusively applicable.
