General terms and conditions for the use of bicycle parking facilities (Bicycle Parking GTC).
1 Area of validity.
1.1 These Bicycle Parking GTC apply to the use of bicycle parking facilities owned or managed by SBB.
1.2 By using the bicycle parking facility, you will be deemed to have agreed to the following terms and conditions.
1.3 Any site-specific terms and conditions of use applicable to individual bicycle parking facili-ties shall apply in addition to these GTC. In the event of any contradiction, the special terms and conditions take precedence.
1.4 SBB reserves the right to amend, supplement or cancel these Bicycle Parking GTC at any time either in full or in part at its absolute discretion. This also applies to improvements and/or changes to the information, products and services described.
2 Usage of bicycle parking facilities.
2.1 General provisions.
The number of available parking spots is limited. No vehicles may be parked outside the spots intended for parking. Spots cannot be reserved or allocated. The right to access is not a guarantee of a free spot. No claims for damages or loss of profit due to a fully occu-pied bicycle parking facility will be accepted.
Permanent parking for a longer period of time is prohibited.
2.2 Freely accessible bicycle parking spots available free of charge.
Freely accessible bicycle parking spots may be occupied free of charge by serviceable two-wheeled vehicles (in particular bicycles, e-bikes, scooters, mopeds) provided there is a free spot available. Vehicles must be parked in an orderly manner. Special bicycles (e.g. cargo bikes, bicycles with trailers) may be parked, but only if there is space within the spe-cially designated areas. Roadways must not be blocked.
2.3 Secure cycle parks.
Parking is only permitted for bicycles and e-bikes (incl. cargo bikes, bikes with trailers).
Only those who have a valid season ticket or day pass for use of the secure cycle park as well as a valid Velocity vignette on their bike/e-bike are entitled to access the secure cycle park. The vignette can be procured from the dispenser on site at the secure cycle park and must be permanently affixed to the saddle support so that it is clearly visible.
It is forbidden to allow unauthorised persons access to the cycle park. Violations must be reported to SBB AG via the following telephone number: 0800 117 117.
2.4 Non-authorised use.
Any usage other than for the parking of vehicles permitted for the specific bicycle parking facility within the marked parking spaces in the bicycle parking facility is prohibited, includ-ing in particular:
- Parking of three-wheeled or four-wheeled vehicles (except special bicycles, such as e.g. cargo bikes, bicycles with trailers)
- Parking of motorcycles, mopeds, kick scooters, motor scooters, motorised kick scoot-ers (electric motor or combustion engine) and other vehicles with a combustion engine in a secure cycle park
- Cleaning and repair of two-wheeled vehicles (except bicycle parking facilities with washing and/or repair stations)
- Smoking, consuming food or beverages, bringing in animals, begging, consuming ille-gal substances
- Draining and topping up fuels, oils, etc.
- Storing flammable items and materials, and rubbish.
- Posting or distributing advertising materials (flyers, business cards etc.) without written permission from SBB
- Commercial use (advertising, sale, rental, etc.) without the written permission of SBB
2.5 Disclaimer of liability.
Usage of the bicycle parking facility is at the user’s own risk. This particularly applies in wintry conditions. Any liability on the part of SBB is excluded to the extent permissible by law. Accordingly, SBB AG declines all liability for accidents, partial or complete damage or theft of the vehicle or its equipment to the extent permitted by law. It is advisable to secure vehicles with an adequate lock.
2.6 Infringement of the terms and conditions of use.
SBB is authorised to arrange for a vehicle to be removed at the cost of the user and, if necessary, to destroy any locks without compensation in order to do so if:
- the vehicle is no longer serviceable
- any leaking part or other defect represents a hazard to the proper operation of the site or risks causing contamination to the site
- in the secure cycle park: the required parking fee was not paid or not paid in full
- for motorised vehicles: the vehicle is not roadworthy or has been taken off the road by the police
- a vehicle is parked in a way that contravenes the above terms and conditions of use.
Any permanently parked vehicles will be marked as such and removed after a period of 14 days. Two-wheeled vehicles removed from the site will be put in storage. After a period of two months, any such two-wheeled vehicles may be disposed of or repurposed.
A fee of CHF 50 will be charged in the event of any breach of the parking regulations or any unauthorised use. In a secure cycle park, the fee is also payable if the parking space is occupied for longer than the period of use paid for, or if the parking charge has not been paid in advance. The right to assert a claim for higher compensation for damages is re-served.
Instructions issued by SBB staff and authorised SBB representatives must be complied with.
2.7 Enforcement of the terms and conditions of use
SBB or third parties mandated by SBB may conduct inspections for the purpose of en-forcing the terms and conditions of use. SBB is also entitled to issue orders for the pur-pose of enforcement.
3 Place of jurisdiction and applicable law.
The courts of Bern, where SBB has its registered office, shall have sole jurisdiction over any disputes arising in relation to the operation or use of the bicycle parking facility be-tween you as the user of the bicycle parking facility and SBB. Swiss law shall be exclusively applicable.
