These General Terms and Conditions ("GTC") apply to all legal relationships between SBB AG ("SBB") and its customers regarding the use of SBB charging stations at P+R facilities and payment for charging at these stations, unless additional reference is made to further General Terms and Conditions and/or usage regulations. 

By using the charging station, the customer acknowledges these GTC. They form an integral part of the contract concluded between SBB and the customer (the "Contract"). Any differing terms stipulated by the customer or any changes and/or additions to the GTC by the customer are of no relevance or validity to SBB unless SBB expressly agrees to their validity in writing.

Only e-cars that are also using the charging stations may be parked in spaces with e-charging stations. Checks will be made. Parking fines will be issued for offences against the regulations in force. The applicable usage regulations for the P+Rail facility shall apply.

The charging prices are published at sbb.ch/en/echarge. If the web payment solution is used, the prices are displayed directly in the web app. The prices quoted are in CHF per kWh. The prices are inclusive of VAT in each case. SBB may change or adjust the charging prices at any time. The price displayed in the web payment solution or at sbb.ch/en/echarge always applies.

If a customer uses their SwissPass for identification purposes, payment will be made using the payment method stored in their SBB account. Otherwise, the SwissPass GTC will apply.

If the customer is identified by the web payment solution, payment will be made using the credit card specified on the web payment page.

The costs for the charging process will be charged to the customer's payment method immediately after the charging process has been completed.

An amount of CHF 30 will be charged at the start of the charging process as a pre-authorisation. A pre-authorisation is a temporary withholding of a certain amount. This charge is used to check whether the card is valid and whether sufficient funds are available to cover the transaction. The amount is reserved by the card issuer, but not actually transferred. As soon as the final amount has been determined and debited, the pre-authorisation is cancelled.

A valid car park ticket is required to park an electric car in a P+Rail space with a charging station. Please see the usage regulations for the relevant P+Rail facility in this regard.

If the SwissPass is used for identification and payment, a car park ticket is automatically purchased at the start of the charging process and the actual parking time is automatically charged at the end of the charging process. The relevant P+Rail location prices apply. Holders of a P+Rail pass will not be charged for a car park ticket.

If the web payment solution is used for identification and payment, the car park ticket cannot be charged automatically. A car park ticket must be purchased separately using the P+R app or another channel. 

The customer undertakes 

• only to connect chargeable electric or hybrid vehicles which are approved for road use to the charging station; 
• only to connect vehicles which, with their components (such as charging cable, plug etc.), comply with all applicable legal requirements and are ready for use and in a safe and properly maintained state; 
• to follow the vehicle manufacturer’s instructions regarding the length of the charging session and the maximum power; 
• to use the charging station in accordance with these GTC and to follow all instructions and directions for use; and 
• to protect the charging station and its surroundings against damage to the best of their ability within their sphere of influence.

If a warning is issued by means of warning lights on the charging station and/or in the customer’s vehicle, the customer must take all necessary steps that are required to guarantee their own safety and the safety of third parties as well as to protect their vehicle. In particular, the customer should immediately disconnect the vehicle from the charging station, if this can be done safely, and call the Swisscharge support hotline. The customer shall be liable to SBB for any damage caused to the charging station or its surroundings in breach of this Section 4.3.

SBB's charging stations and the access and payment solutions are generally available to customers 24 hours a day, 7 days a week. However, SBB cannot guarantee that its network will function without interruptions or disruptions, nor can it guarantee any specific charging times or capacities. SBB is authorised to temporarily restrict or suspend the availability of its charging stations and access options in the following cases:

• in the case of interruptions for operational reasons, such as system faults, troubleshooting or tasks relating to maintenance and updates;
• in the case of the failure of the telecommunications cables or the Internet connection between the charging station and the servers belonging to SBB or its service providers;
• in the case of overload or underload in the power supply network;
• in cases of force majeure, extraordinary events and natural phenomena;
• in all other cases that render this absolutely necessary.

The customer is liable to SBB for any damage caused by them to the charging station and/or its surroundings through negligence or wilful intent while using the charging station.

In respect of itself and its assistants, SBB shall be liable only for damage caused wilfully or through gross negligence. Any further liability on the part of SBB, in particular for consequential damage, loss of profit or lost or altered data, is excluded.

The SwissPass Privacy Policy applies to identification using a SwissPass swisspass.ch/dataprotectionLink opens in new window.. The data is anonymised for analysis purposes after 12 months.

The following data protection conditions apply to identification using the web payment solution:

In connection with the provision of services under this contract, SBB may collect, store, process, use and pass on to third parties customer data provided by the customer or generated by the customer's use of the charging station (in connection with the charging of the vehicle) in compliance with applicable data protection standards at all times, insofar as this is done (i) to fulfil contractual obligations towards the customer, (ii) to maintain, develop and preserve the customer relationship, (iii) to individualise the e-mobility software or provide personalised content or advertising or (iv) to advertise, design and further develop SBB products and services.

SBB shall implement measures which reflect the state of the art to keep personal data confidential and to protect data against unauthorised access.

Should one of the provisions of these GTC be or become invalid or unenforceable, the validity of the remaining provisions of these GTC shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid or enforceable provision that most closely reflects the invalid or unenforceable one in legal and commercial terms.

The contract and the rights and obligations arising from it may not be transferred without the other party’s written authorisation. 

This contract is subject to Swiss substantive law. The exclusive place of jurisdiction is Bern.
