General Terms and Conditions GTC of the public transport prepaid card. (Hereinafter referred to as prepaid card).

Below you will find the GTC for the prepaid card for public transport of the participating transport companies, represented by Swiss Federal Railways SBB, 3000 Bern 65 (hereinafter referred to as SBB).

1. General.

The prepaid card for public transport is a physical prepaid card which is used to record the customer’s credit balance with respect to SBB in CHF. The customer can use the prepaid card to purchase goods and services from the participating transport companies. These General Terms and Conditions govern the relationship between the customer and the transport companies. The customer accepts the applicable General Terms and Conditions and undertakes to comply with them.

2. Purchase and top-up of the prepaid card.

The prepaid card can be purchased and topped up at all participating transport companies at staffed counters. Top-ups can be done by cash, Twint, debit card, or credit card. It is not possible to top up the prepaid card with Reka Cheques / Reka Cards. The prepaid card can be purchased and topped up remotely at sbb.ch/en/prepaid-card The minimum top-up amount is CHF 10 per prepaid card. A maximum of CHF 3,000 can be topped up per prepaid card. The prepaid card can be topped up to a balance of CHF 3,000. A maximum value of CHF 3,000 in prepaid cards can be purchased per person. This amount may not be exceeded during the entire period of validity of the prepaid card. The customer undertakes to comply with these provisions and to ensure that the recipient of the prepaid card is made aware of the GTC.

3. Possible uses of the prepaid card.

The possible uses will be continuously expanded and can be viewed at sbb.ch/en/prepaid-card. The prepaid card cannot be used for the following services:

Currency exchange transactions, TravelCash, Western Union, insurances, prepaid mobile, Bitcoin, gift cards, prepaid payment cards, Viacash, Paysafecard, Paysafecash, Visa Prepaid, QR invoices. Further restrictions are possible.

The credit balance (full amount or remaining balance) of the prepaid card cannot be paid out in cash.

The physical prepaid card must be inserted into the card reader for payment or held up to the reader using the contactless function. No PIN or signature is required. Should payment with the prepaid card not be possible due to a technical fault, SBB has the right to refuse payment with the prepaid card. Furthermore, SBB reserves the right to require the customer to present official identification.

4. Remaining balance.

The remaining balance of the prepaid card can be checked at sbb.ch/en/prepaid-card or via the printed QR code using a device.

5. No interest.

The credit balance on the prepaid card does not bear interest.

6. No fees.

No fees are charged for top-ups, recharges, balance enquiries or payments.

7. Validity and expiry of the prepaid card.

The credit balance expires 5 years after the last use, i.e. the last top-up or debit of the prepaid card. Authorisation requests/balance enquiries do not count as use of the card.

8. The prepaid card holder's duties of due diligence.

Customers must keep the prepaid card safe and protect it from misuse by third parties. Customers agree to acknowledge all transactions completed using their prepaid card and to bear all consequences arising from its use.

9. Liability.

The prepaid card is non-person-specific and transferable. It should therefore be treated in the same way as cash. SBB accepts no liability in the event of loss or theft of the prepaid card. In the event of loss or theft, the credit or remaining balance of the prepaid card will not be replaced. No liability is accepted by SBB for losses incurred by customers as a result of system failures, disruptions, unlawful interference with communication networks or other deficiencies. SBB reserves the right to suspend the service at any time without indicating any reasons if a security risk is identified.

10. Cancelling transactions.

If a transaction with the prepaid card was triggered in error, the customer must report this immediately at a staffed counter or at the SBB Contact Center and must present the transaction receipt. Services purchased in error can be exchanged. Cash payment is not possible. Cancellation and topping-up of the prepaid card is only possible in certain cases if the service cannot be exchanged.

11. Data protection.

No personal data is collected or stored. However, should such data be collected on the basis of sections 2 and 3 above, SBB undertakes to comply with the statutory provisions of the Data Protection Act. If customers provide contact details such as a technical network address or e-mail address when making a balance enquiry, topping up or when making online purchases, this data will be used to provide this service. The customer acknowledges that SBB may involve third parties, in which case it shall ensure that the contact details are protected by appropriate technical and organisational measures and our privacy policy.

12. Applicable law and place of jurisdiction.

These General Terms and Conditions are governed by Swiss law. The place of jurisdiction is Bern. Binding legal provisions remain reserved.

13. Validity of the General Terms and Conditions.

The currently valid version can be accessed here or at any service counter. The customer recognises the relevant valid version of the General Terms and Conditions as published by SBB. In the event of any discrepancy between the German, French, Italian and/or English versions of the GTC, the German version shall prevail.
