General Terms and Conditions of Business.

1. Introduction.

SCE Online is a service provided by SBB Servicecenter Einnahmen (hereinafter referred to as "SBB"). The contractual relationship on which these GTC are based is entered into by the traveller (hereinafter referred to as the "Customer") with SBB.

2. Subject matter of the contract.

These General Terms and Conditions (GTC) govern the relationship between the Customer and SBB for the subsequent presentation of a personal season ticket and/or basic card as well as for the payment of outstanding claims due to travel on public transport without a valid or with a partially valid ticket.

3. Service.

If the customer is unable to present his/her personal travelcard or basic travelcard during a ticket inspection on public transport, this can be done retrospectively using the "Travel without a valid travelcard" form either at a ticket office within 10 days or via SCE Online.

If the details of the personal travelcard can be successfully verified within the tariff period, the incident will be debited in the collection system. 

If the validity of the subscription cannot be recognised or if the 10-day period for presentation has expired, no debit will be made in the collection system. In this case, the CHF 5.- will be credited to the incident as a deposit and deducted from the invoice amount.

If no valid ticket could be presented at the time of the ticket inspection, the outstanding debt can be paid directly via SCE Online. 

4. Participating transport companies.

The service is also provided for other public transport companies. The authorisation to use the service is given by the transport company carrying out the check and/or can be found in the information provided during the ticket check.

5. Prices and terms of payment.

The price of the service is based on the Tariff 600 "Common Ancillary Tariff Provisions for National Direct Transport and the AssociationsLink opens in new window.". The price must be paid in advance on conclusion of the contract via SCE Online using MasterCard, VISA, PostFinance, American Express, Diners Club, Reka and TWINT.

6. Conclusion of contract and right of cancellation.

Once payment has been completed in SCE Online, the contract shall be deemed to have been concluded and the service shall be provided immediately. There is neither a right of withdrawal nor a right to a refund.

7. Data protection.

When processing personal data, SBB complies with the provisions of Swiss data protection legislation. Details can be found at: sbb.ch/en/dataprivacy.  

8. Warranty and liability.

SBB and the customer are liable for all damage caused to the other party unless they can prove that they are not at fault. Liability is limited to the actual, proven damage.

9. Amendment of the GTC.

SBB reserves the right to amend and supplement these GTC at any time and at our sole discretion. Please consult sbb.ch/en/rogf regularly. 

10. Severability clause.

If any provision of these GTC proves to be invalid or unlawful, the validity of the GTC shall not be affected thereby. In this case, the provision in question shall be replaced by a valid provision that is as economically equivalent as possible.

11. Jurisdiction and applicable law.

The contractual relationship shall be governed exclusively by Swiss law. The exclusive place of jurisdiction is Zurich. Mandatory places of jurisdiction are reserved.
